Creditor & Real Estate Litigation

Creditor Representation

When you’re owed money and need help collecting, have a mortgage or equipment lien to enforce, or have other needs, we can assist you. We represent various entities – including mortgage servicers and investors, banks, individual lenders, and businesses – in enforcing their creditors’ rights in connection with:

  • Commercial and Residential Foreclosures
  • Bankruptcies
  • Reformation and Quiet Title Actions
  • Replevin Actions
  • Lien Enforcement
  • Landlord Representation (see below)
  • Land Contract Litigation (see below)
  • Commercial Collections (see below)
  • Civil Litigation (see below)
Commercial and Residential Foreclosure

If a borrower defaults on a loan by missing payments or failing to meet other requirements, clients can recover unpaid debts and undertake property foreclosure. We handle all aspects of both commercial and residential cases.

Bankruptcies

If a debtor files for Chapter 13 bankruptcy, creditors are limited in the actions they can take. That said, we represent creditors when a debtor files for bankruptcy, typically filing motions for relief when debtors stop making their Chapter 13 plan payments.

Landlord Representation

For clients in a disagreement regarding a lease, security deposit, rent, or eviction, we offer legal representation. We advocate for either landlords or tenants involved in legal conflicts concerning rental properties. We draft leases and can represent clients through an eviction proceeding.

Land Contract Litigation

Some clients require legal assistance if the terms of a land contract are violated. This breach could happen if the buyer fails to make payments or meet other contractual obligations. We handle negotiations, draft real estate documents, and support clients through any legal proceedings.

Commercial Collections

When a business provides a product or service to another business, the business anticipates payment. When payment isn’t received, legal assistance may be necessary. We guide clients through understanding your legal entitlements concerning unpaid debts for ordered products or rendered services.

Civil Litigation

When an individual or business has wronged a client, the court system can provide a forum for resolution. We handle cases regarding real estate litigation, evictions, landlord-tenant disputes, and contract disputes.

Commercial Real Estate

Navigating the complexities of buying or selling commercial real estate demands skilled legal counsel. Special Needs Law & Estate Planning

Elder Law

We help protect the rights of a loved one over the age of 65. We have extensive experience protecting the rights of financially exploited, abused, or neglected individuals and serving as Guardian ad Litem.

Incompetency/Guardianship

If a loved one becomes mentally incapacitated, clients may need to initiate incompetency proceedings to have a guardian appointed. This is sometimes necessary due to age, illness, or disability. A guardian is appointed to act on their behalf. We assist in these proceedings, supporting clients and their loved one every step of the way.

Guardian ad Litem

In cases involving disputes regarding a minor child or mentally incapacitated adult over allegations of abuse or when the individual has special needs requiring a court evaluation, we advocate for them. We represent their best interests and serve as their voice in navigating these complex situations.

Estate Planning and Wills

We protect client families and their futures by exploring legal options and estate planning. We assist in drafting wills, creating trusts, and helping clients make informed decisions for their estate.

Surplus Funds

In a foreclosure action, extra funds may result from the sale of the property. These funds are deposited with the county clerk of court until claimed. We represent both individuals and corporate entities who are entitled to the funds and petition the court on their behalf for the funds to be returned.
